Finally some action in the right direction (time for the green flag to come down on lead-free???)

News like that really makes my day, Patrick

Good one Dave, but isnt it a good sign that nonsense are unlikely to be written into law in our country?

Arnie was born in the EU and so am I but that doesnt mean were ignorant. We just saw what we saw and moved on!!

You're correct. It is a good sign for Americans. It's a shame the Euros let their emperors run around in their skivers.

Does anyone know of any instance of a pending or successful prosecution in the EU in regards to RoHS legislation?

Darby,

To my knowledge no case of RoHS (lead) violation has ever gone to court in the EU.

The only documented RoHS (lead) violation (again that Im aware of) has been settled out of court in the UK.

Check here: http://www.eetimes.com/news/latest/showArticle.jhtml?articleID=202401949

Im not a lawyer but know the EU court system and believe it would be easy to come out of a court case concerning the use of lead in electronics victorious based on:

- No evidence that lead in electronics is harmful to people or environment. - Supporting documentation from the EPA that lead-free alloys are more damaging to the environment in many ways (reason why an exemption for the use of lead in the electronics is still under consideration). - Still pending exemption for lead used in electronics. - One could argue that using lead in electronics is protecting the consumer since at the time the directive was written into law no unbiased reliability studies were available comparing lead alloys with lead-free alloys (and still not as of today). - Climate change is a hot topic in the EU and the higher energy use with lead-free solders is unquestionable contributing to a large increase in emissions of green house gasses. - Lead is proven very effective in tin whisker mitigation and a cell phone can be an important life saver equal to a pace maker in critical circumstances. - The EU is more reliability conscious then the US at the consumer level; it would be easy to proof that lead-free alloys shorten the life expectations of electronic equipment thus increasing the electronics waste stream. - Lead is also known to mitigate tin pest and again no studies to proof that lead-free is safe in this area.

To add to the case Belgium (Brussels) is without a government for 6 months now, it would be relatively easy to question the credibility of the RoHS legislators.

I dont know of any other case in history where you have the potential to become a hero by breaking the law in order to protect people and the environment.

I rest my case, Patrick Patrick@interfluxusa.com

Good points Patrick. It really shows how little (if any) thought EU legislators put into the RoHS rules they came up with.

What? If you are talking about the US, you think there is NO nonsense already in our laws? Come ON! (There are entire novelty books with laws that are so insane or outdated they are roll on the floor laughable.)

Never though an American would know about our little country beeing without a gouvernement for half a year.

In Belgium, this is how law making goes: 1. First think of a rediculous proposistion. 2. Make it a law and execute it 3. Find out that is rediculous 4. Postpone it 5. Execute it again but decide to never check if anyone ever actually obeys it.

This is the best we can hope for in RoHs IMO :)
